Application to become a bargaining party
Once an application to initiate bargaining has been approved, any eligible union can also apply for approval to become an employee bargaining party within the bargaining side. An eligible employer association can also apply to become an employer bargaining party within the bargaining side.
Applications must be made in writing and on the form issued by MBIE.

Fair Pay Agreements and employee contact details document
The Fair Pay Agreements and Employee Contact Details Document provides employees and employers that are covered by a proposed Fair Pay Agreement, with information about the employer’s obligation to share employee contact details with the initiating union or employee bargaining side. It also includes information about how an employee can request that their contact details not be shared.
This document also includes an optional form which employees can use if they decide not to share their contact details with the initiating union or employee bargaining side. If employees agree to having their details shared with the initiating union or employee bargaining side, they don’t need to do anything. Using this version of the form to opt out of having contact details shared is optional.

Public submissions form
If the initiating union’s application is based on the 10% representation test or the public interest test MBIE may invite public submissions before deciding whether to approve the initiation application.

Application to change coverage during bargaining
This form is used by bargaining sides if they agree to change the proposed coverage during bargaining. Bargaining sides must apply to the Ministry of Business, Innovation and Employment for approval of the amended proposed coverage.

Application to cease being an eligible bargaining party
This form is used by a bargaining party to apply for approval to cease being a bargaining party. If a bargaining party decides it no longer want to be a bargaining party for a proposed Fair Pay Agreement, the bargaining party may apply to the Ministry of Business, Innovation and Employment for approval to cease being a bargaining party.

This form is used by a bargaining party to notify the Ministry of Business Innovation and Employment that it is no longer eligible to be a bargaining party.
