How to resolve problems

There are processes to follow when working through employment relationship problems. Employers and employees should use these and try to resolve problems in a positive way.

    When an employment issue is raised, it’s important to act promptly and follow an agreed process for resolving problems.

  • Resolving issues yourselves

    When an issue is raised, those involved should try to resolve the matter themselves first.

  • Talking to your employer

    If you have an issue you want to discuss with your employer, you should properly prepare for the meeting.

  • Early resolution

    Early resolution is a free, impartial phone-based service that helps employers and employees resolve a workplace issue quickly and informally.

  • Mediation

    If an employment issue cannot be resolved informally by the parties themselves, mediation may help them to reach an agreement.

  • Personal grievances

    A ‘personal grievance’ is an action that you can take against a current or former employer when you have an employment issue you are unable to resolve.

  • Disciplinary action

    Sometimes employee behaviour is unacceptable and disciplinary action is necessary. Disciplinary action can take a number of forms.

  • Records of settlement

    If you come to an agreement about an employment issue, you can formalise it in a ‘record of settlement’. Once reviewed and signed by our mediators, this document is legally binding.

  • Labour Inspectorate complaints

    You can complain to the Labour Inspectorate if you see or suspect a breach of employment standards.

  • Escalating unresolved issues

    Employers and employees can take further action if they cannot resolve employment problems.
